My Fiji is a business operated by The Holiday Centre Pty Ltd ("The Holiday Centre", "My Fiji", "we", "us") ABN 76 120 978 083, part of the RewardsCorp Group. The Holiday Centre is a licensed travel agent (Licence No. TA3172360).
The terms and conditions below apply to your purchase and booking of a My Fiji holiday. It is important that you understand and agree with these terms and conditions, and you should not proceed with any purchase or booking unless you do. By proceeding with a purchase or booking, you confirm your agreement with the terms and conditions below.
1. AGENCY:
The Holiday Centre acts as an agent only. We offer a range of travel services (such as flights and accommodation) on behalf of others who provide those services (such as airlines and resorts). Our duties to you are limited to arranging bookings on your behalf with those service providers. We are not responsible for providing those services to you. If a service provider fails to provide you with a travel service, you agree that your only rights are directly against the service provider and not against us. You agree that we are not liable to you for any losses that you suffer in those circumstances, and that you will not claim against us (directly or indirectly) any refund, credit or other dispute. You agree that any money that you have paid to us, has been paid to us for the purposes of us forwarding payment on your behalf to the service providers to secure the booking for your travel services. If you have paid any amount to us by credit card, you agree that you will not lodge any dispute with your credit card issuer about the validity of your credit card transaction with us where a service provider fails to provide a service to you for any reason.
2. LIMITATION OF LIABILITY:
Our liability to you is limited to taking reasonable care in arranging for travel services to be provided to you by third party travel service providers. We do not accept any liability, whether in contract, tort or otherwise, for any act or omission of those travel service providers including their failure to provide a service. We do not make any representation about the standard of the services to be provided by third parties, and we accept no liability in that regard. We do not accept any liability, whether in contract, tort or otherwise, for any injury, losses, expenses, delays or inconvenience suffered by you in connection with your booking or your travel services, unless caused by our negligent act or omission or unless our liability is prescribed by legislation which cannot be excluded. Where our liability cannot be excluded, our liability is limited to the amount that you have paid for your travel services.
3. RATES AND PRICES:
Rates and prices quoted in print or on the website and quoted by our reservations personnel are subject to change without notice prior to final payment being received by us. Rates and prices do not include any costs incurred en route to and from the destination, meals and/or alcoholic beverages (unless specified), telephone calls, items of a personal nature, and personal services not specified as being included in costs on the relevant web pages for each supplier’s product. We reserve the right to vary quoted rates and prices in the event of changes in exchange rates or price rises made by wholesalers, airlines or other suppliers. If the cost of any service increases prior to full pament of your holiday due to exchange rate fluctuations, price increases, tax changes or any other reason, you must pay the increase when notified. We are not liable in any way if any increase occurs. All rates and prices are subject to availability and can be withdrawn or varied without notice.
4. DEPOSITS & FINAL PAYMENTS:
Any booking deposits and final payments are required by the dates as specified on our booking confirmation and invoice. Failure to make payments within these time limits may result in automatic cancellation of the booking. We accept no responsibility for loss incurred or increase in costs due to automatic cancellation. Payment of a deposit merely holds the reservation and does not guarantee that the final payment amount will not change due to circumstances beyond our control as referred to in clause 3. Booking confirmation and invoiced amounts are current at the time of booking.
A non-refundable deposit amount of $1250 per adult and $500 per child is payable within 7 days of confirmation of your reservation, unless, at the time of confirmation you are advised by our personnel of any additional deposit or full payment requirements.
5. PAYMENT OPTIONS:
Payment can be made by cheque, money order, bank transfer or with the following credit cards - Visa, MasterCard, (a 1.5% credit card surcharge will apply) or Diners Club, Amex (a 3% credit card surcharge will apply). With payment by cheque, bookings can only be confirmed upon receipt of cleared funds.
6. CANCELLATION CHARGES & OTHER SERVICE FEES:
We are unable to provide a refund to you until we receive the funds from the relevant supplier. Cancelled bookings will incur charges. We will refund to you any amount which you have paid to us and which we have not already paid (or are not legally obliged to pay) on your behalf to service providers. In that case, you agree that we shall be entitled to retain a booking fee applicable to your booking ($200 per person) which is a reasonable remuneration for the services that we have provided and is a reasonable estimate of the expenses incurred by us in advertising, facilitating and booking your holiday.
Amendment Fees:
Booking amendments will incur a minimum fee of $55 per person, together with any additional amendment fees applied by the service providers.
Other Service Fees:
We reserve the right to apply other service fees in addition to those charged by airlines, resorts and other service providers, for any services provided by us in addition to those included in your holiday package. Some of these fees may include, but are not limited to credit card surcharges, late booking fees, visa processing fees and urgent documentation delivery. Please ask one of our team for a copy of the applicable Schedule of Fees.
7. TAXES:
Australian departure tax is recorded on your ticket as being paid. All quoted taxes are subject to change until tickets are issued. There are still some countries where taxes are paid upon departure from the airport.
8. RESERVATIONS:
Reservations (even after payment of your deposit and final payment) are subject to us receiving confirmation from the service provider. Where a reservation request cannot be confirmed by the supplier, you will be offered the choice of alternative arrangements, which may be at an additional cost. Any accommodation and/or cruise free upgrades are always subject to availability at the time of booking.
9. AIRLINE MEALS and AIRCRAFT SEATING:
Please note that bulkhead seats are generally reserved for families travelling with infants. Exit row seating cannot be reserved by us and is only made available at check-in. For all other seating requirements, your request can be made but is not guaranteed and is subject to availability. Any special meals, if available, must also be requested at the time of booking.
10. FLIGHT SCHEDULE CHANGES:
The airlines have the right to reschedule or cancel flights at any time. If you have paid in full and are holding tickets, the airlines accept no responsibility to accommodate any changes made that don't suit you. We will use our reasonable endeavours to assist you to rebook on the closest flight time or date available, subject to availability. We do not accept responsibility should changes occur nor do we accept responsibility for any additional cost incurred by you to make alterations to your booking to accommodate these changes as these are beyond our control.
11. TRAVEL INSURANCE:
The Australian Government advise that all travellers obtain travel insurance prior to travel. The insurance should cover loss of deposit and other monies through cancellation, loss or damage to personal baggage and loss of money, medical expenses, additional expenses to cover hotel accommodation and repatriation costs to Australia should any services need to be extended or curtailed due to illness or other insurable risk. Our reservations personnel can provide you with general information about travel insurance at the time of booking. If you do not require travel insurance you agree to provide written acknowledgement that a recommendation to obtain travel insurance has been made to you by us.
12. INCORRECT NAMES:
You are responsible to supply all passenger names exactly as they appear on your passports. If the spelling of any name itemised on a booking confirmation is different to the name on that person's passport/photo identification - PLEASE ADVISE US IMMEDIATELY. Failure to provide your correct names may require a re-issue of tickets and other documentation and you accept responsibility for this cost. In some cases you may have to pay more for your ticket if there are no seats available to rebook in the same fare type as the original ticket. Any fees will be the responsibility of the passenger.
13. TRAVEL DOCUMENTATION:
Passports:
Passports are required by all passengers travelling internationally and are always the responsibility of the passenger. Most countries require travellers to have at least six months validity remaining on their passports beyond the period of intended stay, and immigration authorities may refuse entry if you arrive with less than this. Airlines and passenger shipping lines may refuse to carry you if your passport has inadequate validity.
IMPORTANT: Please forward a copy of the first page (photo) of your passport/s to us prior to final payment. Travel Documents will not be issued unless this is received.
Travel Documents:
Travel Documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. All Travel Documents are non transferable. All airline tickets must be issued in the name of the passport/photo identity holder, some carriers will deny carriage if the name varies and the booking may be cancelled. It is your responsibility to ensure you have all required Travel Documents prior to travel. We will not be held responsible for tickets and/or documentation lost by a third party. Any charges associated with re-issue and re-sending of tickets and/or documentation will be at your expense.
Visas and Vaccinations:
Visa and health requirements are the responsibility of all individual travellers. Permanent residents travelling on a foreign passport may be required to hold a valid returning resident Visa. Our consultants will assist in providing information. This information as well as other related information supplied by us is supplied in good faith and should be treated as a guide only. The final responsibility for ensuring documentation is correct and current is that of the individual traveller. Our consultants are not qualified to advise you on vaccinations. 14. DEPARTMENT OF FOREIGN AFFAIRS & TRADE - TRAVEL WARNINGS:
We make no representations as to the safety, conditions and other issues that may exist at any destination. For reasons of political unrest, acts of war or terrorism or natural disasters in certain parts of the world the Australian Government in conjunction with various other worldwide bodies may decide to issue a Government Advisory Warning to Australian Passport holders not to travel to that country. In these instances whilst travel to some countries is not advisable and some clauses of the travel insurance coverage may not be effective we appreciate that some travellers may still need to travel to those areas. Whilst we are prepared to make these bookings on your behalf we do so without responsibility or liability. Current travel warnings and other information is available on the Department of Foreign Affairs website at www.smartraveller.gov.au
It is recommended that all Australian travellers register their personal details i.e. Passport numbers, contact details in Australia and the countries you will be visiting so that in case of emergency you can be contacted.
15. CANCELLATION DUE TO GOVERNMENT ISSUED TRAVEL WARNING
If you, acting reasonably, cancel your holiday as a result of a travel warning issued for your travel destination by the Australian government as referred to in clause 14, we will refund to you any amount which you have paid to us and which we have not already paid (or are not legally obliged to pay) on your behalf to service providers. In that case, you agree that we shall be entitled to retain a booking fee applicable to your booking (a minimum of $200 per person) which is a reasonable remuneration for the services that we have provided and is a reasonable estimate of the expenses incurred by us in advertising, facilitating and booking your holiday.
16. WEBSITE AND BROCHURE INFORMATION:
Product descriptions, maps and images of accommodation and services featured are based on current information provided by tourist offices, hotels and other suppliers. Facilities are subject to change at any time and we do not guarantee the standard, class, or fit for purpose of that accommodation or service. Maps are shown for general information and may not reflect actual locations or services provided. Images show geographic areas, but are not necessarily included in the holiday. Hotel room images are representative only; actual rooms occupied may vary in decor and inclusions. Photographs and illustrations and other promotional material are for promotion purposes only. They do not represent any benefit that will be included in any arrangements made by us on your behalf.
17. TRAVEL COMPENSATION FUND:
The Holiday Centre is a member of the Australian Travel Compensation Fund (TCF). TCF is a fund administered by a regulatory body established by government to give passengers financial protection in the event of a member's failure. The Holiday Centre passengers can have complete confidence that the Company meets the strict financial criteria necessary for participation in the TCF.
18. PRIVACY LAWS:
You acknowledge that you will provide us from time to time with information about you of a personal nature ("Personal Information"). You consent to us using any personal information for the purposes of making and completing airline bookings and travel related arrangements on behalf of the client.
